Export Control of Dual-use Items to The United States

On December 3, the Ministry of Commerce issued an announcement on strengthening export control of relevant dual-use items to the United States. According to the relevant provisions of the Export Control Law of the People's Republic of China and other laws and regulations, in order to safeguard national security and interests and fulfill international obligations such as non-proliferation, it is decided to strengthen export control of relevant dual-use items to the United States.

Dual-use items are prohibited from being exported to military users or for military purposes in the United States.

In principle, the export of dual-use items related to gallium, germanium, antimony, and superhard materials to the United States will not be permitted; for the export of dual-use items of graphite to the United States, stricter end-user and end-use reviews will be implemented.

Organizations and individuals in any country or region that violate the above provisions and transfer or provide relevant dual-use items originating in the People's Republic of China to organizations and individuals in the United States will be held accountable in accordance with the law. The announcement will be officially implemented from the date of publication.

The spokesperson of the Ministry of Commerce answered questions from reporters on strengthening export controls on relevant dual-use items to the United States

Q: We have noticed that the Ministry of Commerce has issued an announcement to strengthen export controls on dual-use items to the United States. What are the considerations?

A: In recent years, the United States has generalized the concept of national security, politicized and weaponized economic, trade and technological issues, abused export control measures, unreasonably restricted the export of relevant products to China, and included a number of Chinese companies in the sanctions list for suppression and containment, seriously undermining international trade rules, seriously damaging the legitimate rights and interests of enterprises, and seriously undermining the stability of the global industrial chain and supply chain.

In order to safeguard national security and interests and fulfill international obligations such as non-proliferation, in accordance with the Export Control Law of the People's Republic of China and other laws and regulations, China has decided to strengthen export controls on relevant dual-use items to the United States, including prohibiting the export of dual-use items to military users or military purposes in the United States, and strictly controlling the export of dual-use items related to gallium, germanium, antimony, superhard materials, and graphite to the United States. Any organization or individual in any country or region that violates relevant regulations will be held accountable in accordance with the law.

The Chinese government is determined to promote high-level opening up to the outside world and resolutely opposes any wrong practice of generalizing the concept of national security. China is willing to strengthen dialogue with relevant countries and regions in the field of export controls and jointly promote the security and stability of the global industrial chain and supply chain.
